Do we even have a constitution anymore?

It's all lip-service with a token nod to freedom and a humble bow towards a draconian state that resembles something orwellian.

It is something to recall on a thing like this.....Police don't get to decide what a reasonable mistake is. A Judge will decide the definition of reasonable, when a case comes up.

Judges are as often ..or sometimes more often...drawn from the ranks of defense counsel as they are from prosecutors. Depends on the level of court and who is doing the appointing.

So..I see the cops side, if it really is a legitimate good faith error. I also have confidence that enough Judges will use the 'reasonable' standard to throw enough cases out the window over time for this to have as much negative meaning for a cop as it does anything positive.

The Constitution used to state very clearly what the limits of government were.

Now?

The politicians and courts are blurring that limit, that line.

The conviction should have been tossed..

Regardless of the search request. Good faith on thier part is not a civic virtue

I am expecting to see things on the news were people start killing cops at their homes in retaliation..

As for the abuse potential.. look at the seizure of cars and cash by local police departments..

I don't know how many times we've seen on the 'Cops' show, the cops asked to search someone's car and when the person says no, the cop threatens to take them to jail for obstruction
So naturally, they give in but usually go to jail for whatever it is they were hiding any way

What gets us is when a cop says, 'Now had you been upfront with me from the beginning, you would not be going to jail'
Oh what a crock of BS!! LMAO...
 
Cops can & do find a way around to get what they want, if they see the need for it

That being said, how many perps have been let go due to improper evidence handling and procedures by the police?
And I'm not talking about planting evidence but rather where an officer forgets to read them their rights or improper bagging/tagging evidence, paper work etc. etc., all that can cause a case to get thrown out

So maybe, just maybe, this will help balance things out
A lot of times, cops will collect stuff,  with the good intentions of helping a case, not thinking about it being "legally justified" or not





 

This is not going to be a real popular response I am about to utter.

The situations that have been described ..

Change absolutely nothing at all. If the stop is invalid, then whole incident and evidence gained is the fruit of a posionius tree. It is the price of freedom and it not the pleasant side of it. It has lead down a path to where we are today. Slowly but surely the rights are revoked for one reason and then another, in the name of protection. All based on fear and other issues.

No matter how it is worded or the reasons given you can not start making exceptions to the ideal because so called reality says it must be done. This is because of lord Auctions quote of absolute power corrupts absolutely. It translates in every situation where those that decided that in the name of perceived security then seize upon those forms and function for personal gain and they cause more harm then the original reasons logically given.

I am not giving up rights so later on someone can claim my cash in my pocket was used in the drug trade. Or because my phone is on they have the right to download what is on there during a traffic stop. Or they have the right to seize my house and land because of imminent domain to build something others in the community decided they want the land for. The worst extension is the fact of a no knock warrant allowing them to come into the house and kill whoever they want. With the addition of the bounty hunters being allowed unlimited access to any house they want because they are doing their jobs.

No thank you.. I have to respectfully disagree on this point. It easier to save the world with one pebble now then it is to fight a tyrant who is embedded in every thought and function of life.

You can not give up our greatest weapon which is liberty, in the name of protecting society with top flight security.

Next thing you know they will be saying which consenting adults can marry who
Or who can own and who cant own a fire arm
or manipulate who can vote and who cant vote
Or what you can say.. Such as yell fire in a theater
or what can and cant be published- I will know porn when I see it

All these issues where covered by the founders in the bill of right clearly. It has however been limited in the name of security

The first mistake down this road lead to the whiskey rebellion
All other mistakes have since followed this protocol
It is America's usher event and we are paying the price today for it

I am actually quiet serious

I have watched people walk in those cases
with the support of authority
(payback was B$%^&.. )

I have experienced way to much dealing with those with authority
they do what they want when they want

in those cases the academic answer is no
the real life answer is no

Their is no reason to give them the authority to do that
Rabbit I do not want to argue but I cant accept the conditions you named

This is the problem with society and civilization
Those with any form of power abuse it 99.99%
so far to be f***ing honest
