It seems the reaction to the attempt at control over the World Wide Web isn't going well, and it isn't looking good in this humble bunny's opinion. We didn't know what it contained when we knew there was a problem with it, and that was thanks to people inside the FCC. Now that some have had a chance to look more into this? The plot (and BS) thickens a bit ...but also may clarify how this attempt may very well die hard, and in its early stages.
Indeed... This is one of many things now happening outside the system of Legislative and Executive branch balance our nation was built upon. Once again, a royal decree from 'on high' is all that exists to justify or explain the need for this ...and Obama seems to fail at a basic understanding here. He cannot make things happen by personal whim. Not for LONG...anyway. Our system doesn't work like that, and he doesn't own the courts. Not even close to it.
He also seems to really hate capitalism or free markets in any form, whatsoever. Lack of control, it seems, annoys him on a personal level, for his determination to exert control over everything in our nation.
The problem is.....our system doesn't work like he'd imagine it does. Not even with a wanna-be dictator at the helm. If he DID have the courts..it would be different. However, he doesn't, and the courts he has attempted control in have not generally gone the way he'd have liked or expected, I believe. Judges are like that though. They get where they are, then they owe loyalty to no man or ideal. (A good thing, up to this point.)

Judges also, historically, have almost no tolerance for 'flying by the seat of the pants' approaches to national issues where regulatory changes or law is passed for a solution. As it should be, to be realistic about it.

For starters, the order lacks evidence of why the Internet, the greatest source of innovation in modern times, must now submit to rules written for the monopoly telephone system. The order doesn’t include basic market and economic analysis that courts demand to justify new regulations, especially when an agency reverses its own precedents.

The order admits the FCC doesn’t know what many of its new rules mean. The order says the agency will “watch, learn, and act as required . . . a process that is sure to bring greater understanding to the commission.”
